General
Welcome to our site. This website is owned and maintained by Singapore LPA Services Pte Ltd.

These Terms and Conditions (“Terms”) govern your access to and use of our website, our Lasting Power of Attorney (LPA) certification, LPA activation support, and mental capacity assessment services, and any related digital platforms (collectively, the “Website” and “Services”).

By accessing or using the Website, or by booking or receiving our Services, you agree to be legally bound by these Terms. If you do not agree with any part of these Terms, you should discontinue use of the Website and refrain from booking our Services.

We may update or revise these Terms from time to time to reflect changes in our services, legal requirements, or business practices. Any changes will be effective immediately upon posting on this page. Your continued use of the Website or our Services after such changes constitutes your acceptance of the updated Terms.

Eligibility

Our Services are intended for individuals aged 21 years and above, in accordance with the Mental Capacity Act's requirements for making an LPA. Donees named in an LPA must also be aged 21 or above.

Booking, Appointments & Fees

Appointments are made via our Website's appointment request form. Upon submission, we will contact you to confirm an available date, time, and location for your home or institution visit.

You are responsible for ensuring that the donor, and where applicable the donee(s), are available at the confirmed appointment time, and that the donor has a valid Singpass account with digital signing enabled, where required for electronic signature of the LPA.
 

For LPA certification, each donor must be interviewed, for an appropriate duration stipulated by the Certificate Issuer, both individually and in private, without the donee(s) or other family members present, in accordance with safeguards against undue influence. This requirement cannot be waived, regardless of the circumstances of the booking.

Our current fees are published on our Fees page. Full payment is required via our designated payment provider prior to your consultation, and does not include the OPG's own application, registration, or activation fees, which are payable separately and directly to the OPG.

Fees are charged for the professional service of conducting your consultation and assessment, and not for any guaranteed outcome. If a donor is assessed as not having the mental capacity required to make the LPA, certification will not proceed, and the consultation and assessment fee remains payable in full, as the service has been rendered regardless of outcome.

Mental capacity assessments are conducted based on clinical examination and information available to the assessor at the time of assessment. Capacity is decision-specific and time-specific, and a finding made at one point in time does not guarantee the same finding at a later date.

Ltd. and is protected by intellectual property laws. Nothing on this Website grants you any licence or right to use any intellectual property beyond viewing it for your own personal reference. You may not copy, reproduce, modify, distribute, publish, or create derivative works from any part of the Website without our express written consent.

We make reasonable efforts to ensure that the general information on this Website is accurate, current, and complete. However, this content is provided for general informational purposes only, may not always reflect the most current OPG or regulatory requirements, and does not constitute legal or medical advice. We do not guarantee the accuracy, completeness, or reliability of any information and disclaim any obligation to update content except as required by law.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages, losses, or expenses arising from your use of, or inability to use, the Website or our Services, including any delay, error, or omission in the OPG's own registration or activation process, which is outside our control.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under Singapore law.

 

Indemnity

You agree to indemnify and hold harmless Singapore LPA Services Pte. Ltd., its directors, officers, employees, and partners from any claims, liabilities, damages, losses, or expenses arising from your use of the Website, your breach of these Terms, or inaccurate or incomplete information provided by you in connection with our Services.

Your use of the Website and our Services is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect your personal data in accordance with the PDPA. By using the Website or our Services, you consent to the collection and use of information as described in that policy.

We reserve the right, at our sole discretion, to suspend, restrict, or terminate your access to the Website, or to decline or discontinue providing Services to any individual, at any time, including where we believe these Terms have been violated, or where we assess that providing the Service would not be appropriate or safe.

Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore. You agree to submit to the non-exclusive jurisdiction of the Singapore courts for any disputes arising out of or in connection with these Terms or your use of the Website or our Services.
